Wiretapping is the
recording of telephone conversations by a third party. The aim is to listen in
an electronic communication on telephones, computers, and other devices. Many
goverments use it as a low enforcement tool to look for information from an
extraordinary crime such as corruption and bribery case. Given the indonesian’s
planning to use phone tapping as the key in eradication corruption. Law
enforcement is planning to arrange startegies in combating corruption. Thus,
one of a good way is using phone tapping. The writer try to discuss whether
wiretappinng can be allowed or not according to indonesian’s law.
The wiretapping
activities is a new breakthrough for KPK ( Corruption Eradication Commission )
in overcoming corruptions. This institution should have the right to conduct
surveilance and wiretapping activities in order to launch move operations.
Therefore, it is in line of corruption eradication efforts. Considering the law
on KPK, previously the KPK had no regulations that order the wiretapping
activities.
Since then, wiretapping
has become much more complex, and concerned citizens have sometimes questioned
the legality of this practice, especially in countries which place a high value
on privacy rights including indonesia because Wiretapping conversations need to
be regulated because it could infringe on the rights of our citizens to privacy.
KPK has a role in
eradicating corruption, and then the KPK has authorities in holding the right
to wiretap conversations. If KPK is allowed to wiretap conversations as freely
as they can, this intitution would be able to progress and become a stronger
institution than it already is. It is known that for KPK to be allowed to
wiretap conversations, a court order needs to be issued before such action
could be undertaken.
To sump up, The KPK
might be allowed in using wiretapping as long as it is related to corruption
cases and had undergone a proper procedure. In addtion, using wiretapping
conversations is a new thing that need to be considered according to applicable
laws in indonesia.
